The Scholars Club is the trade name of The Scholars Club Institution Inc, a company incorporated in Canada.

This “Privacy Policy” governs the manner in which “The Scholars Club” collects, uses, maintains, and discloses information collected from users (each, a “User”) of its www.thescholarsclub.com website, applications, and technology platform, and any derivative or affiliated websites on which this Privacy Policy is posted, linked, or referenced (collectively, the “Platform”). The Platform is owned and operated by The Scholars Club Institution Inc. Please note that this Privacy Policy covers The Scholars Club practices regarding information collected from its Platform. This Privacy Policy (together with our Terms and Conditions) establishes the basis on which any personal data we collect from you, or that you provide us with, will be processed. This Privacy Policy supplements the other notices and is not intended to override them.

This Platform is not intended for children, and we do not knowingly collect data relating to children. Parental supervision is required if children are to use this Platform.

What Information do we collect and how long do we keep it?

1.1 The information The Scholars Club collects

You may provide us with information, including information that can be used to identify you (“Personal Data”) by using our Platform, filling out forms on the Platform (i.e., the sign-up procedure), when you participate in any of our competitions, promotions or surveys, when you correspond with us by phone, e-mail or otherwise, and when you need assistance with the Platform.

1.1.1 Mandatory information

Information required to register for the service we provide on our Platform, It includes your First and last name, Email address, and password. All these fields are mandatory. The Scholars Club will not be able to provide you with the services offered on our Platforms if the required information is not provided. Consequently, you will not be able to register for a user account on our Platforms.

1.1.2 Personal Information

It includes date of birth, gender, cell phone number, Photograph, Postal Address, Biography Links, A record of any correspondence between you and The Scholars Club, A record of any requests you have made or related ads you have placed with or through our Platform.

1.1.3 Educational and work-related Information

1.1.3.1 Scholars Data

It includes details regarding your education and employment, the subjects you may tutor, the level at which you may tutor those subjects, types of services you offer, your prices, any previous tutoring or experience you may have, your travel preferences, qualifications, native language, details regarding your education and employment, any photos or videos that you choose to upload, information received from references that you provide, feedback from students who have used your services as a tutor, supporting documents you choose to upload, certificates and other documents that you have agreed to provide to us and information you provide in your biography.

1.1.3.2 Students Data

It includes the subject in which you desire tutoring, your level of education, your travel preferences, qualifications, native language, details regarding your education and employment, any photos or videos that you choose to upload, supporting documents you choose to upload, certificates and other documents that you have agreed to provide to us and information you provide in your biography.

1.1.4. Information you submit or otherwise provide or authorize us to collect.

We collect the information you post on our Platform. This includes comments, reviews, documents, questions, chats, messages, assessments, videos, or photos. Such shared content may be publicly viewable by others depending on where it is posted, shared, or viewed. We also collect any other information you may provide to us or authorize us to collect, including any other identifier that permits the ability to contact you. If you communicate with The Scholars Club by e-mail; post messages to forums; make telephone or cell phone calls or texts; communicate through electronic devices or other interactive devices; complete online forms, surveys, sweepstakes, or contest entries; or communicate with The Scholars Club by any means, any information provided in such communication may be collected by The Scholars Club. Information we may require from you when you report a problem with our Platform or our service, such as the subject of your request for support.

1.1.5 Location information

Location information when you have given consent to the collection and processing of this data.

1.1.6 Surveys, testimonials, comments, reviews, and blogs.

You may decide to participate in a survey, to provide a review, to provide a testimonial, to comment on a blog or social media post, etc. If you decide to participate or comment, then you may provide certain information that may include personal information. In addition, we may post customer testimonials/comments/reviews on our Platform that may contain personally identifiable information; however, if/when that happens, we obtain the person’s consent via email or other means prior to posting the testimonial, which authorizes us to post certain information along with their testimonial. We may invite you to complete a survey or participate in a promotion, either through the Platform or through a third-party platform. If you participate, we will collect and store the data you provide as part of participating. That data is subject to this Privacy Policy unless otherwise stated in the official rules of the promotion or survey, including notifying winners and distributing rewards. Where we use a third-party platform to administer a survey or promotion, the third party’s privacy policy will apply.

1.1.7 Account details and financial information.

Accounting details or financial transactions including transactions carried out through our Platform or otherwise. This may include information such as your payment card or bank account details, details of lessons that you have offered through our Platforms.

1.1.7.1 Payment Information

If you make a transaction with us, we (or our business partner(s) who process payment transactions for us) may collect your billing or other financial information in order to process the transaction(s). Please note that for security we do not store sensitive cardholder data, such as full credit or debit card numbers or card authentication data.

1.1.8 Information about your activity on our Platform.

Details of your visits to our Platforms and the resources that you access. We may collect information about your browser type, language preference, and date/time of each visitor request. The purpose in collecting non-personally identifying information is to better understand how Users use the Platform. We may collect information about your operating system, Internet Service provider information and IP addresses and other device identifiers, such as mobile device information. In addition, we may collect information about your use of the Platform. A User browsing the Platform without registering an account or affirmatively providing personally identifiable information to The Scholars Club does so anonymously.

We use certain third-party services to assist us in analysis, auditing, research, and reporting regarding the Platform.

1.2 Information that The Scholars Club collects Automatically

1.2.1 Signup via Social media channel

If you sign up via the social media authentication method, The Scholars Club will access certain Personal Data (e.g. first name, last name, picture, email, number of Facebook friends, etc.) on your social media account pursuant to the applicable terms and conditions of these social media platforms. We may also collect some of your Personal Data when you interact with third-party social media features, such as the “Like” functions.

1.2.2 Network and Technical Information

With regards to each of your visits to our Platforms we may collect, in concordance with the applicable laws, and your consent where required, information related to the devices you use and the networks you are connected to when using our services. This may include the following information: your IP address, log-in information, browser type and version, browser plug-in types and versions, operating system and platform, advertising identifier, information about your visit including the URL clickstream to, through, and from our Platform, products you viewed or searched for, download errors, length of visits to certain pages, page interaction and any phone number used to call our customer service department. We collect this information using various technologies including cookies.

1.2.3 Aggregated Information.

We also collect aggregated information regarding your activity on our Platform (such as the number of lessons offered, your message response rate, etc.). Such information may be published on your public profile on our Platform.

1.3 Data retention

We store the information collected as described in this Privacy Policy to fulfill the purpose(s) for which the information was collected, to provide services through the Platform, to resolve disputes, to pursue legitimate business purposes, to enforce our agreements, to establish legal defenses, to prevent fraud, and to comply with applicable laws.

1.5 Information Sharing

We may share information that we collect about you in the following ways:

1.5.1 Community members

When you use our services, some information about you is shared with the members of our communities, either on your public profile or during the request process (e.g., we give your telephone number to the members with whom you will have a lesson).

The Scholars Club may disclose personally identifiable information collected from Users to its parent, subsidiaries and other related members, trusted affiliates, independent contractors, and business partners who will use the information for the purposes outlined in this Privacy Policy, as necessary to provide the services offered by or through The Scholars Club and to provide the Platform itself, and for the specific purposes for which the information was collected. These members are not permitted to use your personally identifiable information in any other way.

In conducting the matching process between a student and a Professional, we may share a student’s information with the Professional who may provide or will be providing tutoring or instruction to the student so that the Professional may evaluate the engagement and personalize and tailor the tutoring/instruction to the student. In each case, we collect such information only in so far as is necessary or appropriate to fulfill the purpose of the User’s interaction with The Scholars Club.

1.5.2 Platform data sharing

We contract with select third party vendors to provide services on our behalf, for example, services such as email, hosting, cloud storage, maintenance, backup and analysis, communications software, marketing, business strategy, banking, payment processing, professional services, background checks, etc. We also share non-personal information (such as aggregate user statistics, de-identified information, demographic information, etc.) with third parties such as advertisers, content providers, and analytics providers. We are also working closely with third parties which may be the recipients of your Personal Data such as:

  • Our business partners who are social media platforms and which may provide you with connecting services, such as the connection of the information of your profile, from their social media platforms to our Platforms.
  • Our business partners who may advertise their services on our Platforms and to which you may decide to sign up for: these services may be any service related to our services such as network services, banking services, etc.
  • Our business partners who may advertise our services on their websites.
  • Our subcontractors in technical, payment services, or analytics providers.

1.5.3 Necessary data Sharing

We only share your Personal Data with any of these third parties in the following cases:

1.5.3.1 Service Provider

Where it is necessary to involve a third-party service provider, for the performance of any contract we enter into with you in order to facilitate or extend our services (e.g., if we charge you any fees or collect any money from you in relation to any services on the Platforms).

1.5.3.2 Community members

As part of the request process and in order to provide the services, information such as your name, photography, mobile phone number and/or email address, may be displayed on the Platforms and/or passed on to tutors (if you are a student) or students (if you are a tutor).

1.5.3.3 Explicit Request

It is explicitly requested by you (e.g., with when using social media authentication methods).

1.5.3.4 Business Partner

We may distribute parts of our Platforms (including the lessons you have posted) for display on our business partners’ websites through API or widgets. In these cases, some information from your public profile may be displayed on these websites.

1.5.3.5 Legal duties

The Scholars Club may also disclose your information if required to do so by law or in a good faith belief that such access, preservation, or disclosure is reasonably necessary to

1.5.4 Rating System

As part of our rating system, the reviews you write will be published on the Platforms. The reviews including your abbreviated name and photograph are visible to all visitors of the Platforms.

1.5.5 Search Engine providers

We use analytics and search engine providers to assist us in the improvement and optimization of our Platform.

1.5.6 Business acquisition, sale, or merger, or in connection with investor relations.

In the event that we sell or buy any business or assets, in which case we may disclose your Personal Data to the prospective seller or buyer of such business or assets; and

If The Scholars Club, or all or part of its assets are acquired by a third party, in which case Personal Data held by it about its members will be one of the transferred assets.

The Scholars Club may also disclose aggregate, anonymous data based on information collected from Users to investors and potential partners.

Users may always refuse to supply personally identifying information, with the caveat that it may prevent them from engaging in certain Platform-related activities.

1.5.7 Distribution

You authorize us to use your name, your profile picture, your content as part of commercial, sponsored, or related content that we distribute or improve. We do not transmit your content or information for resale to any third party.

1.5.8 Law & Regulation

In accordance with applicable laws and where required with your consent, we may combine information about you, including your Personal Data and cookie information, we send to and receive from our business partners. We may use this information and the combined information for the purposes set out above.

The Scholars Club may disclose personally identifiable information at the request of law enforcement or governmental agencies or in response to subpoenas, court orders, or other legal process, to establish, protect, or exercise The Scholars Club legal or other rights or to defend against a legal claim or as otherwise required or allowed by law.

The Scholars Club may disclose personally identifiable information in order to protect the rights, property, or safety of a User or any other person.

The Scholars Club may disclose personally identifiable information to investigate or prevent a violation by User of any contractual or other relationship with The Scholars Club or the perpetration of any illegal or harmful activity.

1.5.9 Partners privacy policies

We draw your attention on the fact that if you decide to share your information, including Personal Data, with us through our business partners’ connecting services, any of our business partners’ privacy policies and/or notices may also be applicable to you, in addition to this Privacy Policy. We do not control the collection and/or the processing of your information eventually made by our business partners on their own platforms.

2.1 Messaging System

2.1.1 Analyzing Messages

We may review, scan, or analyze the messages you exchange with other members of our community through our Platforms for fraud prevention, service improvement, customer support purposes, enforcement of the contracts entered with our members (such as our Terms and Conditions). For example, to prevent the circumventing of our online search engine, we may scan and analyze messages sent through our Platforms to check that they do not include any contact details or references to other websites.

2.1.2 Noncommercial use only

We will never scan or analyze your messages with other members of our community for commercial and advertising purposes. We may use automated methods to carry out the moderation of these messages, but no automated individual decision-making is performed in this regard.

4.1 Links to third-party websites and apps

Please note that the Platform may contain links to other Sites. These linked sites may not be operated or controlled by The Scholars Club. The Scholars Club is not responsible for the privacy practices of these or any other Platforms, and you access these Platforms entirely at your own risk. The Scholars Club recommends that you review the privacy practices of any other Platforms that you choose to visit.

In accordance with applicable laws and where required with your consent, we may use the information you give us on our Platforms for electronic direct marketing purposes e.g.

4.1 Links to third-party websites and apps

Please note that the Platform may contain links to other Sites. These linked sites may not be operated or controlled by The Scholars Club. The Scholars Club is not responsible for the privacy practices of these or any other Platforms, and you access these Platforms entirely at your own risk. The Scholars Club recommends that you review the privacy practices of any other Platforms that you choose to visit.

5.1 Information Storage and transfer

The Scholars Club is based, and this Platform is hosted, in Canada. If User is from the European Union or other regions of the world with laws governing data collection and use that may differ from Canada data privacy law and User is visiting, accessing, or otherwise using the Platform, please note that any personally identifiable information that User provides to The Scholars Club will be transferred to Canada. Any such personally identifiable information provided will be processed and stored in Canada by The Scholars Club or a service provider acting on its behalf. By providing personally identifiable information to The Scholars Club, User hereby specifically and expressly consents to such transfer and processing and the uses and disclosures set forth herein.

6.1 Social Media Widgets, Blogs, and Professionals’ Profiles/Bios

6.1.1 Social Media Widgets

Our Platform includes Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini programs that run on our Platform. These Features may collect your IP address, which page you are visiting on our Platform, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Platform. Your interactions with these Features are governed by the privacy policy of the company providing it.

6.1.2 Blogs

Anytime you post on our blog please be aware that you are posting using a third-party application, and we have no access or control over this information. To request removal of your personal information from any blog, you can either log into the third-party application and remove your comment or you can contact the appropriate third-party application. Your interaction with these features is governed by the privacy policy of the company providing it.

6.1.3 Professionals’ Profiles/Bios

If you are contracted as a Professional through the Platform, then the profile you create on our Platform will be publicly accessible unless otherwise indicated. You may change the privacy settings of your profile and make it non-public through your account portal, or as otherwise set forth in the terms of your independent contractor agreement.

7.1 Confidentiality of your password

Where you have chosen a password which enables you to access certain parts of our Platforms, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

8.1 What are your rights in respect of your personal data?

8.1.1 Right of Access

You have the right to access any of your personal data we hold. While you may always access your data via your account and account settings, we may also provide your information to you in a structured format, if you so choose.

8.1.2 Right to Revoke Consent

You always have the right to revoke any consent you have given for us to use your data.

8.1.3 Right to Object to Processing

You have the right to object to our processing of your data except where we can demonstrate that our compelling interests, or the compelling interests of a third party, override your interests.

You always have the right to opt-out of any marketing emails or other correspondence we may send to you.

8.1.9 Right to Opt-Out of Automated Profiling

Tutors have the right to opt-out of our automated profiling of tutors related to search result ranking. You may opt-out in your account settings.

By checking (or not checking) certain boxes on the forms we use to collect your data.

By opting out or exercising certain of your rights via the settings in your account; or

9.1 Cookies Policy

COOKIES are small files containing information that is transferred to your computer’s hard drive that can be read by your web browser. Our website uses several different types of cookies to improve our site and your user experience. They cannot be used to identify you personally, cannot carry viruses, or install malware.

What is a cookie?
